Richard McCullagh graduated from Macquarie University with a BA LLB in 1984. Within a year he started working in the area he has always worked and come to specialise in, the law relating to the operation of retirement villages in New South Wales. Once, almost purely the domain of contract law in the ‘80’s, there came a light-weight Code of Practice in the early ‘90’s, a tighter replacement Code in the mid-‘90’s, culminating in the highly prescriptive Retirement Villages Act in the ‘00’s. Under the Codes, a resident with a grievance had to get the prior written consent of the Director-General to apply for an order to the “Commercial Tribunal”. Now, under the Act, operators are exposed to over 60 penalties and 70 orders readily available to residents in the “Consumer Trader and Tenancy Tribunal”, where Richard has represented operators on many occasions. He has dealt with village documentation under license, leasehold and strata title in NSW & QLD and works in-house for Babcock & Brown Communities Ltd.
